These terms govern public access to and use of SAMDDRA’s websites, member portal, applications and related online services (“the Platform”). Membership-specific rules, fee schedules or programme conditions may also apply and will be presented when relevant.
1. About SAMDDRA
SAMDDRA is the South African Mobile Devices Distributors and Repairers Association. References to “SAMDDRA”, “we”, “us” or “our” mean the association operating this Platform. Questions may be sent to info@samddra.org.za.
2. Acceptance of these terms
By accessing the Platform, creating an account or using a service, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the Platform. If you use the Platform for a business or organisation, you confirm that you are authorised to bind it.
3. Eligibility and accounts
- You must provide accurate, current and complete information.
- You are responsible for safeguarding your password, authentication methods and account access.
- You must promptly notify us of suspected unauthorised access.
- You may not impersonate another person, create a misleading account or transfer an account without approval.
- We may request identity, business or authority verification where reasonably required.
4. Memberships, applications and verification
Submitting an application, KYC information or supporting documents does not guarantee membership, certification, approval or access to a programme. We may verify submitted information, request corrections or further evidence, and approve or reject applications according to applicable membership and programme rules.
Membership periods, benefits, renewal requirements, fees and cancellation rules shown during an application or renewal form part of the agreement for that membership. Where those specific rules conflict with these general terms, the specific rules apply to that service.
5. Fees, invoices and payments
Prices and fees displayed on the Platform are in South African rand unless stated otherwise. You must review an invoice before payment and use the correct payment reference. Payment is only treated as complete once cleared and recorded by SAMDDRA or its authorised payment or accounting provider.
Refunds, credits and cancellations are subject to the applicable service terms and mandatory rights under South African law. Nothing in these terms excludes rights that cannot lawfully be excluded under the Consumer Protection Act or other applicable legislation.
6. Acceptable use
You may not:
- use the Platform unlawfully, fraudulently or to harm another person;
- upload malicious code or attempt to bypass security or access controls;
- scrape, overload, reverse engineer or interfere with the Platform except where law expressly permits;
- submit content that infringes intellectual-property, privacy or other rights;
- use another person’s personal information without lawful authority; or
- misrepresent qualifications, membership, certification or affiliation with SAMDDRA.
7. User content and documents
You retain ownership of information and documents you submit. You grant SAMDDRA a limited right to host, copy, review and process them only as needed to operate the Platform, administer services, verify applications, comply with law and protect legitimate interests. You confirm that you have the right to submit that content.
8. Intellectual property
The Platform, SAMDDRA branding, layouts, software and published materials are owned by or licensed to SAMDDRA and protected by applicable law. You receive a limited, revocable, non-transferable right to use the Platform for its intended purpose. No trademark or other proprietary right is transferred to you.
9. Third-party services and links
The Platform may connect to payment, accounting, email, hosting, identity-verification or other third-party services. Their own terms and privacy practices may apply. SAMDDRA is not responsible for unrelated third-party websites merely because the Platform links to them.
10. Availability and changes
We aim to keep the Platform secure and available, but do not promise uninterrupted or error-free operation. We may maintain, change, suspend or discontinue features where reasonably necessary. We will take reasonable steps to communicate material changes that affect active services.
11. Suspension and termination
We may restrict or suspend access where reasonably necessary to investigate security concerns, prevent harm, comply with law, address non-payment or respond to a material breach. Where appropriate, we will give notice and a reasonable opportunity to correct the issue. You may stop using the Platform at any time, but existing payment, record-retention and membership obligations may continue.
12. Disclaimers and liability
Information on the Platform is general and does not constitute legal, financial or professional advice. To the fullest extent permitted by law, SAMDDRA is not liable for indirect, special or consequential loss arising from use of the Platform. Nothing in these terms limits liability for fraud, gross negligence, wilful misconduct, or any liability or consumer right that South African law does not allow us to exclude.
13. Electronic communications
You agree that account notices, application updates, invoices and other service communications may be delivered electronically using the contact details you provide. Electronic records and communications may be used as evidence to the extent permitted by the Electronic Communications and Transactions Act.
14. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Please first contact us at info@samddra.org.za so we can try to resolve a concern fairly. You retain the right to approach any regulator, ombud, tribunal or court with jurisdiction.
15. Changes to these terms
We may update these terms for legal, security or service changes. The revised date will appear at the top. Material changes may also be communicated through the Platform or by email. Continued use after an updated version takes effect constitutes acceptance where permitted by law.
16. General
If a provision is unlawful or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. These terms, the Privacy Policy and applicable service-specific terms form the agreement concerning your use of the Platform.
